Members Need Not Obey Dept Order that Illegally Infringes on Their First Amendment Rights

The Department recently issued D.O. 89, which asserts that in addition to EEO restrictions, "material presenting opinions or viewpoints is not permitted anywhere in quarters." The prohibition explicitly applies to both Department and non-Department matters. The D.O. also prohibits the posting of any articles/materials from any publication or the internet. After reviewing this Order with counsel, we are convinced it is an unconstitutional infringement of our members' First Amendment rights. For example, the D.O. would prohibit a member from possessing a bible, newspaper or magazine in the firehouse. It would also prohibit the showing of any televised opinions or the accessing of on-line materials.

Accordingly, we are directing our members to ignore D.O. 89, with the exception that members must still obey EEO guidelines that prohibit racial, gender or age discrimination. Our members should feel free to possess and discuss newspapers, magazines, and any materials containing opinions and viewpoints. While the FDNY does own our firehouses, we do not forfeit our First Amendment rights when we walk through the firehouse doors.

If any members are subjected to discipline or the threat of discipline for failing to obey D.O. 89, please immediately notify your UFA Borough Trustee.

Freedom of Speech

Considering the Department Order issued on December 29, 2011, the numerous citywide EEO raids that followed it and the media coverage this produced, it would be hard to be unaware that the ability of FDNY members to not only express their beliefs but also have the opportunity to learn about the beliefs of others has been under attack. Thankfully, the Order has been scaled back a bit. We urge all to comply with the current Order issued on January 25, 2012 regarding the posting of materials on bulletin boards or anywhere else in quarters but also remind everyone that the prohibition that ?material presenting opinions or viewpoints is not permitted anywhere in quarters? has been superseded. Do not abuse this; material that may be (a very subjective and broad standard) discriminatory or obscene is still prohibited. Merit Matters material is not ? just don?t post it.

It is worth noting that upon learning of Margo Ferrandino?s appointment as FDNY Assistant Commissioner for EEO I asked for a meeting with her to present our concerns and help her learn about some of the issues effecting her new position, but was turned down. She also refused to get involved when I pointed out that the plan to visit the homes of black applicants ? only - so they could complete their applications was a demonstrable and blatant violation of the EEO Policy Statement and, frankly, any reasonable person?s idea of fairness. The first ?E? in EEO stands for ?Equal?, not ?Extra?. In stark contrast to this, Ms. Ferrandino wasted no time in implementing a campaign at the behest of the Vulcan Society that had to be quickly altered because it violated the Constitution.

Make no mistake- while these regulations about posting material are not new and all firefighters were harmed by their overreaching application, the recent emphasis is aimed at Merit Matters. Our opponents have apparently been unable to present valid, cogent responses to our numerous Press Releases and other communications so have fallen back on censorship. We will not respond in kind.

We have in the past, will again in the future and urge all to also distribute the statements, positions, associations and arguments offered by the groups, lawyers, government officials and others who believe people should be judged based on the color of their skin. We want their arguments and positions to be broadcast widely because we don?t believe they can stand up to scrutiny.

Merit Matters? philosophy and views can withstand scrutiny and this fuels our efforts to engage our opponents in dialogue through the Essay Contest (which has not received even one entry to date) and our offer to go to Vulcan Hall for a debate with a moderator of their choosing (this offer has thus far been ignored). As President, I will represent Merit Matters alone but place no limit on the number of debaters my opponents are allowed.

Our stand for Free Speech rights is not limited to this Release, and this is most readily illustrated by the filing of our recent Amicus Brief in support of the City?s Appeal. Shortly after our attorneys, Keith Sullivan and James Galleshaw, came on board we indicated we would file this brief on behalf of and to be a voice for NYC residents, firefighters and other supporters. We kept our promise and promise further to remain a voice in favor of safety, high standards and equal treatment for all.
