The Firefighter, identified as Michael Pena, 28, was arrested early yesterday morning within the confines of the 115th Pct. The charges include second-degree vehicular manslaughter, driving while intoxicated, and refusing to take a breath test.
The accident happened around 4:15AM in East Elmhurst, at the intersection of 107th St and Northern Blvd. CCTV video shows FF Pena driving a Mercedes, blowing through the red light and slamming into Drivers the side of a BMW. The BMW Driver, a Justin Diza, 23, a Brooklyn Native, was declared dead at a local hospital. Two passengers in the Mercedes we're also transported and in stable condition.
