Each year in the US, the majority of poisonous snake envenomation incidents occur in young, adult males.

Stupidity, poor judgement and the use of the phrase "Here, hold my beer!" are found in all socio-economic groups, but are found most commonly in the above demographic.
 
No way the Queens or Manhattan DA isn't going to attempt to charge them for this.

Under New York Penal Law § 125.10, criminally negligent homicide is a Class E felony occurring when a person causes the death of another through actions constituting a gross deviation from how a reasonable person would act. It carries a penalty of up to 4 years in prison. It differs from manslaughter in that the offender is not consciously aware of the risk, yet fails to perceive it.
 
If the DA pursues charges they could more then likely be looking at Criminal Trespassing, Reckless Endangerment, Criminal Tampering / Evidence Tampering, Larceny and Endangering the Welfare of a Child

Well by the grace of god this kid isn't dead so probably not gonna be 125.10
